1. General information

By accessing, browsing, or using the Site, the user (hereinafter: the “User”) agrees to be bound by these Terms and Conditions of Use (T&Cs) without reservation.

2. Purpose

These T&Cs govern the rights and obligations between the Operator and the User in accordance with the provisions of the Swiss Code of Obligations (CO) and, where applicable, the Swiss Civil Code (CC). They apply to all use of the Site, as well as to any services and/or products provided online.

3. Access and use of the site

Access to the Site is free of charge.

The User agrees to use the Site in compliance with Swiss law and public decency.

The Operator reserves the right to restrict or suspend access to the Site in the event of abusive use.

4. Intellectual property 

All content on the Site (texts, images, logos, trademarks, code, databases, etc.) is protected by copyright law (Art. 2 et seq. Swiss Copyright Act, LDA) and/or other intellectual property rights.

Any reproduction, distribution, modification, or use of the content without prior written consent from the Operator is strictly prohibited.

5. Data protection (FADP)

The Operator processes Users’ personal data in accordance with the Swiss Federal Act on Data Protection (FADP, SR 235.1).

Data collected is used solely to the extent necessary for the provision of services and to improve the Site.

Users have the following rights: access, rectification, deletion, and objection to the processing of their personal data. These rights can be exercised by contacting contact@cognos-partners.com.

The Operator takes all reasonable technical and organizational measures to ensure data security.

6. Liability

The Operator endeavors to ensure the accuracy of the information published on the Site but cannot guarantee its completeness or timeliness.

The Operator disclaims all liability for any direct or indirect damages arising from the use of the Site, except in cases of gross negligence or willful misconduct in accordance with Art. 100 et seq. CO.

7. Amendments

The Operator reserves the right to amend these T&Cs at any time. The amended version shall apply as soon as it is published on the Site.

8. Governing Law & Jurisdiction

These T&Cs are governed by Swiss law (CO, CC, and related legislation).

In the event of a dispute, the courts at the Operator’s registered office shall have jurisdiction, subject to mandatory legal provisions.
